Casino markers developed as a convenience feature for players. Instead of somebody coming to a casino with a bag of cash or withdrawing money from the bank or selling assets in order to get the money to gamble large amounts at a casino, the casino will offer them a short term loan of a certain amount of chips which the player can use only at the lender casino. Usually the terms of that loan are, regardless of winning or losing, that the player will have to repay the loan in full within about 30 days.

The problem arises when a player takes out a marker loan, loses the entire amount, and then can’t pay it back 30 days later. Here’s where things begin to snowball. Most people don’t understand is that when someone signs a marker, they are not signing an IOU. In Nevada, what they actually signing when they sign a marker is a “personal check.” Even though it’s called a casino marker, according to Nevada law it’s the same as a check out of that player’s checkbook. When the casino then takes that marker and deposits it for payment 30 days later, if there are insufficient funds in the players account, all Hell breaks loose.

An overdue marker does not immediately mean the DA will get a call from the casino.  The casino may try to get the player to pay it back before it ever goes to DA’s office. In most cases, however, the casino will send it to the DA’s office and the DA will send the player a collection letter. It’s important to understand that once the DA gets involved, a 10% fee will be added to all marker balances.

With the District Attorney acting as the collection agency for the casinos, arrest warrants and jail time become part of the collection process.
