Can a casino issue an arrest warrant for a past due casino marker?

The short answer to that is no they can’t! – The casino isn’t a prosecuting agency and the casino cannot issue an arrest warrant, the party who can issue an arrest warrant is the Clark County District Attorney’s Office who acts as the collection agency for the casino. 

All the casinos have relationships with numerous civil law firms and they will file a lawsuit to collect the casino marker in many cases a player can be faced with not only a civil lawsuit meaning a suit where there they are being asked to pay back the marker and they’re getting sued and they have to answer it and they have to hire a civil attorney to defend them in that suit but at the same time there will be a parallel action by the Clark County District Attorney’s Office involving criminal charges and warrants being put out for a player’s arrest for not being able to pay the marker back in time.

In Nevada it’s considered a criminal act to take out a marker and not be able to pay it back pursuant to the contract that the player has with the casino and letting it go overdue in the same way that it’s also considered fraud and this is the basis for the civil lawsuit where if a player takes out a marker and then can’t pay it back one of the main claims that the casino will will file their lawsuit on is a fraud claim which in some cases can allow the casino to request three times the amount of the marker and damages because of the fraud aspect in the case that they’re alleging now obviously this all has to shake out in court but this is why it’s so important that if you get a letter from the Clark County District Attorney’s Office or you get a letter from the casino act on it right away don’t sit on it call a casino marker attorney we can help.
