A Judgment Obtained by a Casino can be 3 Times the Amount Owed

When casinos began multiplying outside of Las Vegas, first on the East Coast and later in the heartland, they adopted many of Nevada’s business practices developed over the decades of legalized gambling in Las Vegas and Reno. One of those practices is the use of the casino marker to facilitate larger amounts of play from those who the casinos considered a good risk. 

The difference between Nevada and other states was, and still is, that Nevada’s economy is mostly based upon tourism tied to gaming, and in other states, casino gambling is a small part of the economy which does not carry the same political or economic clout. As a consequence, gaming laws outside the State of Nevada have characteristics similar to regular business rules rather than the special consideration they get in Nevada. On other words, Nevada laws are highly favorable towards casinos where laws in other states do not give casinos any great advantages over any other types of businesses. 

The practical outcome of this difference between Nevada and other states is that casinos do not have as great an advantage with respect to casino marker collections over players as they do in Nevada, where casinos are king. 

In other states, casinos cannot use the criminal law to enforce markers, they must do what any other creditor must do to collect, file a lawsuit. Although a casino marker lawsuit is not as life altering as a Nevada criminal prosecution, it’s no cakewalk either.  

 

One of the little known aspects of civil lawsuits used by casinos is the concept of “treble damages.” This means that a casino can sue a player for three times the amount owed to that casino, plus attorneys fees and costs. Treble damages is born out of the area of law dealing with fraud. The casinos attorneys will file a complaint that states the marker in question was obtained through fraud. In essence, that the player misrepresented his financial position to the casino to obtain a marker which he eventually did not have the financial ability to pay. Treble damages are not automatically granted by the court to a casino, but must be argued and the fraud shown to exist before these types of damages can be obtained. Obviously, this will require serious legal representation of a player and the costs in attorneys fees could be staggering.

A lot of people make that mistake and here’s the problem with using bankruptcy law to try beating a casino marker debt. One of the aspects of bankruptcy law is that if the federal bankruptcy court can be convinced that a certain debt was obtained through fraud, the same fraud casinos are alleging to get damages in their lawsuit, the marker debt cannot be discharged in bankruptcy. This involves a whole different set of litigation in federal court and it’s a tough situation.
